Uzbekistan enhancing protection of private property

The Senate of Oliy Majlis (upper house of Uzbekistan's parliament) has approved the law "On amendments and additions to some legislative acts of the Republic of Uzbekistan to further strengthen the reliable protection of private property, business entities, removing barriers to their rapid development".

The document has been worked out in accordance with the decree of Uzbekistan's president "On measures to ensure reliable protection of private property, small business and private entrepreneurship, removing barriers to their rapid development" dated May 2015.

The objectives of the law are to further strengthen the legal protection of private property, small business and private entrepreneurship, increasing the responsibility of government officials, law enforcement and regulatory authorities for obstruction and illegal interference in entrepreneurial activity.

By analogy with the Criminal Code, the Tax Code envisages a norm, according to which committing a number of tax offenses envisages imposition of a fine according to their total number.

Also changes to the laws "On audit activity", "On licensing of certain activities" are made, which establish the procedure for renewal of the license by the licensing authority within a period not exceeding three working days. In addition, the possibility of appealing against the refusal to renew the license and compensation for damage caused by such a refusal is

provided.

In order to promptly deal with cases, amendments are introduced in the Commercial Procedural Code of Uzbekistan providing for the shortening of terms for making decisions by economic courts on admissibility of claims to the production and preparation of cases for trial from 10 to five days.

Moreover, the term of considering the cases on the recognition of an act of the state or any other body as invalid and the actions (or inaction) of an official as illegal will be reduced from 30 to 15 days.

The law "On guarantees of freedom of entrepreneurship" excludes the duty of businessmen's appealing to the state bodies to use exemptions and privileges envisaged by the legislation. A unified register of privileges and preferences will be created on a single portal of interactive state services. This will increase the awareness of entrepreneurs about the convenience in doing business.

The law was adopted by the Legislative Chamber of the Uzbek parliament in July 2015. The document will come into force after it is signed by the president and published in the press.
