Single Stage Open Competitive Selection – Request for Proposals
Project Description: The European Bank for Reconstruction and Development (the “EBRD” or the “Bank”) is implementing the Project: Digital Transformation of Public Procurement - Digitalising Public Procurement in Uzbekistan.
In 2018, the Parliament of Uzbekistan adopted a new law on public procurement (the “Public Procurement Law”) which constitutes an important milestone of the government agenda of modernising national public procurement framework as well as its consideration to accede to the Agreement on Government Procurement of the World Trade Organization (the “WTO GPA”). While the Public Procurement Law corrected some coverage problems, further legislative work is needed to bring national legislation in compliance with the mandatory WTO GPA accession requirements and incorporate eProcurement reforms, designed to improve transparency and accountability of public procurement.
The Project aims at delivering regulatory, legal and business advice to improve governance of public procurement processes, expand use of digital public procurement and introduce data-driven reporting, monitoring and procurement market analysis. eProcurement in public procurement is the business-to-government purchase and sale of goods, services and works through an Internet-based platform, as well as other information and networking systems, such as electronic data interchange and procurement planning facilities. eProcurement solutions allow for qualified and registered economic operators to compete for public contracts, following tenders published online by contracting entities. In a complete public procurement eProcurement system, business-to-government transactions can be initiated and completed online, with real-time monitoring and audit enabled, and bureaucracy and formalities limited to fundamentals.
The Project will help to increase the speed and economy of procurement processes while ensuring a full transparency of public procurement decisions.
It is envisaged that Project will cover the following components (together "the Assignment"):
a) development of new digital public procurement legislation, based on the 2011 UNCITRAL Model Law on Public Procurement and in compliance with governance standard of the WTO GPA;
b) implementation of online open data in the Open Contracting Data Standard in the new and existing eProcurement systems in the country to facilitate data-driven monitoring and process management,
c) development of new purchasing techniques and digital procurement tools for specialized public procurement, and
e) digitalizing public procurement under mandate of the Ministry of Finance of Uzbekistan (“Ministry”).
The Consultant will be required to collaborate with existing eProcurement platforms in Uzbekistan as well as with a state-owned enterprise under the Ministry that provides digital services and information services in the field of eProcurement.
EBRD intends to select and engage a consultant (“the Consultant”) to assist with the implementation of the Assignment as described below.
Assignment Description: The selected Consultant will be responsible for providing the services to implement following components:
Component 1. Technical concept development: the development of a concept for eProcurement reform, explaining in detail the business, legal and functional approach to developing a comprehensive eProcurement system for public sector government.
Component 2. Implementation of online open data in the Open Contracting Data Standard format in the existing eProcurement systems in the country and in the new developed digital tools to
facilitate data-driven monitoring and process management for the Ministry of Finance.
Component 3. Legislative drafting: drafting of the secondary legislation for low and high value electronic procurement procedures such as: open tender, restricted tender, electronic auction, framework agreement, online shopping from e-catalogues.
Component 4. Piloting eProcurement tools: development of digital procurement tools and assistance with the piloting of low and high value procurement electronically.
Component 5. Implementation assistance: providing on-going advice and assistance during the Project.

Consultant Selection Procedure: Single stage open competitive selection. Interested firms or a group of firms are invited to submit a Technical and Financial Proposal.
Project Start Date and Duration: The Project is expected to start in October 2020 and has an estimated overall duration of 12 months.
Cost Estimate for the TC Project: EUR 500,000.00 (exclusive of VAT). The estimated breakdown the components are as follows: Component 1 - EUR 100,000; Component 2 - EUR 75,000; Component 3 - EUR 75,000; Component 4 - EUR 200,000; Component 5- EUR 50,000.
The Consultant must determine whether any VAT would be chargeable on the services and the basis for that determination, without taking into consideration the special status of the Bank as an IFI and state this to the Bank in their response to the Invitation for Request for Proposal. To the extent that a Consultant incurs input VAT on goods and services purchased in connection with the provision of services (e.g. VAT on airline ticket) which is not otherwise recoverable by the consultant from the local tax authority, the gross cost to the consultant of such expenses shall be treated as a reimbursable expense.
The scope and budget of the Project can be revised resulting from analysis undertaken in the inception stage.
In the event one consultant cannot meet the EBRD requirements to carry out all the Components the EBRD reserves the right to split the assignment and to select consultants to implement selected components (directly or through a new competitive selection process in accordance with the EBRD Corporate Procurement Policy, depending on the amount of the assignment budget).
Funding Source: It is anticipated that the contract will be financed by EBRD Shareholder Special Fund. Selection and contracting are subject to the availability of funding.
Eligibility: There are no eligibility restrictions based on the consultant's country of origin.
Consultant Profile: Corporate services are required. The Consultant will be a firm or a group of firms (consortia comprising of firms and individuals will need to be identified at selection stage) preferably with previous project experience related to:
i. drafting public procurement legislation and policy documents and experience in international procurement legal standards;
ii. developing and supporting the eProcurement systems development and implementation;
iii. relevant previous project experience in public procurement sector development with proven track record of deliver of similar assignments;
iv. experience working with government and international organisations, experience in Uzbekistan will be considered an advantage.
The Assignment will be implemented by a dedicated project team, led by an appropriately qualified team leader, combining legal, regulatory, e-procurement, business and technology experts.
The Consultant’s team may include international and local consultants as well as civil tech organizations and local business associations. The Consultant should ensure that the appropriately qualified experts are available, as required, for each of the different tasks and activities outlined above.
The Consultant’s team is expected to include as a minimum the following key experts (the “Key Experts”):
Key Expert 1: International Public Procurement Policy Expert with preferably 8 years or more of regulatory expertise and experience in the area of public procurement and international procurement legal standards. Fluency in English and excellent English drafting skills are essential; fluency and drafting skills in Russian will be an advantage.
Key Expert 2: International Digital Procurement/eProcurement Expert with preferably 5 years or more of expertise and experience in developing and piloting end-to-end digital and/or electronic public procurement systems. Fluency in English and drafting skills excellent English are essential; fluency and drafting skills in Russian will be an advantage.
Key Expert 3: International Business Process Modelling Expert with preferably 5 years or more of expertise and experience, in particular with Business Process Modelling Notation (BPMN) and modelling of digitalised public procurement processes.
Key Expert 4: International OCDS Data Expert, with preferably 3 years or more of expertise and experience in the area of Open Contracting Data Standard, date design and analysis of machine-readable public procurement data. Experience in business intelligence tools, data visualisation and BPMN proficiency will be an advantage.
Key Expert 5: International Digital Transformation/IT Expert with preferably 5 years or more expertise and experience in distributed architecture systems, system and data design and developing and piloting eProcurement systems.
Key Expert 6: Local Legal Drafting Specialist with preferably 5 years or more legal and regulatory expertise and experience in the area of public procurement in Uzbekistan and drafting legislation, who will work closely with the local counterparts and international experts throughout the project.
Key Expert 7: Local eProcurement Expert with preferably 5 years or more expertise and experience in electronic bidding, electronic public procurement development and implementation in Uzbekistan who will work closely with the local counterparts and international experts throughout the project.
The key experts may be complemented by other team members and support services to cover all tasks specified in the Terms of Reference.
All Key Experts must be fluent in English. Fluency/proficiency in Russian or Uzbek will be considered an advantage.

The Technical Proposal shall be submitted in English electronically via eSelection not later than the Closing Date, as one single PDF file. The technical proposal should not exceed 30 pages excluding the Declaration Form and CVs (Form 1- TP 1 and Form 1 – TP 6).

Selection Method and Evaluation Criteria:
Technical Proposal Evaluation Criteria
(i) Firm's previous project experience in public procurement sector development with proven track record of delivery of similar projects; experience in Uzbekistan will be considered an advantage (40%)
(ii) Quality of the methodology proposed for the TC Assignments (20%)
(iii) CVs of the Key Experts (40%).
The minimum technical score (St) required to pass is 70.
Opening of Financial Proposals
After the technical evaluation is completed, only the submissions which score 70 or above of the total marks available for the technical criteria will be eligible to have their financial proposals opened.
Combined Technical and Financial Evaluation
The lowest evaluated Financial Proposal (Fm) is given the maximum financial score (Sf) of 100. The formula for determining the financial scores (Sf) of all other Proposals is calculated as follows:
Sf = 100 x Fm/ F, in which “Sf” is the financial score, “Fm” is the lowest evaluated Financial Proposal, and “F” the price of the Proposal under consideration.
Proposals are then ranked according to their combined technical (St) and financial (Sf) scores using the weights (T = 80; F = 20) T + F = 100 as follows: S = St x T% + Sf x F%.
The proposal validity period is 120 days from the deadline date for the receipt of submissions. During this period, the Consultant shall maintain its original Proposal without any change, including the availability of the Experts, the proposed rates and the total price.
The selection will be made from the Proposals received in response to this notification only, on the basis of the submission requirements and selection criteria set out in this Procurement Notice. The highest-ranked Consultant will be selected and invited to negotiate the contract, subject to availability of funding.
Any updates of and clarifications on this procurement notice shall be announced as updates on this notice, without any other notification. In the event of changes consultants will need to download the updated versions. Consultants are required to periodically check the notice for updates. Failure to take the updates into account while preparing the Proposal may result in disqualification or penalties to the scores in the evaluation.
